Due to a bunch of fuckery from some of Charles supposed fans, shit has been leaking, and there's nothing we can do at this point. and these leakers try to justify what they're doing by manipulating Charles' words about his music being public domain.

If you go on the county website for the jail system he was in you will see that they declared him "indigent" Let me explain that, that means he cant provide for himself the basic necessities of life. Clothes, food, etc.

He has intentionally given you 900 songs. On his own. You do not have that many songs out from many other artists, if any. This man has put out no albums. He is clowned by most people in the game. He has been in between prisons and mental institutions for 7 months. His career could possibly be over but he's being given another shot. People in his camp that have convinced him to get back in the game. To give it one more legit try and he has agreed. and when he is on the brink of coming out of the hell he has been in since last August. His fans. HIS FANS. The people who are supposed to care about him and his music, and his career, and his life, and where he goes. The people who he has allowed to know him on a personal level. More so than any artist. Ever. Decide to take it upon themselves to try to mess that up by releasing his old music and convincing themselves there doing the right thing by saying "he said it was public domain" (whiny voice) or "the starchasers are happy"
and maybe he'll get over this quickly. He may come in tomorrow and say its cool. but let the man decide dont be deciding shit for him. Like who do people think they are???
There's more out there that hasnt leaked... Shit needs to stop. Period. If it doesn't he probably wont put out a come back project because of all of this.
So to the leakers and anyone who has encouraged it....

There has been a lot of talk about what is going on with Charles right now and what has happened in the past. The question always comes up almost daily and I'm usually the one answering it anyway so I'm making this document to break everything down in as deep a detail as possible. There will be questions of course but I'll try to include the answers in this note as well.

Summary of what has happened so far

We all know Charles was arrested on December 10th, he was referrred to the mental facility on January 31st so he recieved about 2 months of time served. While in the mental faciltiy he was not getting credit for time served.

His stint in the mental facility, based on the fact that he is still facing the charges was because they didnt think he was competent to stand trial. Based on what I know I will assume they didnt think he understood the seriousness of his situation and therefore could not assist in his own defense. As of Monday they decided he was competent and he is set to be arraigned (read all that he is facing, has his chance to make his plea of guilty or not guilty etc., and will have another chance for bail potentially)

Charges

Charles faces 6 total charges.

2 counts of Assault
1 count of resisting arrest
1 count of grand theft (not auto)
and 2 counts of aggravated theft
I was going to break down the penal codes (the stuff that looks like 2913.02.(A)1 but thats a little too much to explain, if you care about all that I will but I just want you to get the basics)

The thefts all fall under the regular theft clause in the Ohio penal code which means basically that he took something that didnt belong to him without consent. The aggravated part of the thefts is key though, it means he threatened or intimidated someone and that makes the charge worse obviously.

Sentences he's facing

This is the part I'm kind of upset to have to share...
The situation is more serious than we all believed, even me, until I looked at his updated records (which Adam Brown led me to) here's what he's looking at.

The least serious is the resisting arrest... for that he's looking at up to 6 months
For each of the 2 assault charges he is looking at 6-18 months
The Grand Theft is a 4th degree felony in Ohio and also carries a sentence of 6-18 monthsand means that he stole something between a value of $5,000 and 100,000.
The aggravated thefts (2 counts remember) are the most serious and the ones where I would need a little more information to be exactly sure but here's the potential. Aggravated theft falls into two sentencing categories.
3rd degree theft, aggravated theft carries a sentence of 1-5 years and a fine of $10,000
2nd degree theft, aggravated theft carries a sentence of 2-8 years and a fine of $15,000
Regardless as to which he is being tried for remember there are two counts...

If he is convicted...

Worst case scenario Charles is found guilty of all charges, he is looking at a minimum total sentencing of 3 and a half total years. Due to his lack of a violent criminal past his sentence is likely to fall near the minimum. This DOES NOT mean he will serve that time, and im not talking about good behavior.

When you are found guilty of multiple charges the judge has the power to make the charges run consecutively or concurrently

Consecutive means that the charges are served back to back and you would then add them together. say he was given two sentences of 6 months, that would mean he would serve them back to back aka 12 months.
Concurrent means that the charges will be served at the same time. This would be the better outcome. This would mean if he's convicted of two 6 month charges, he will serve, just 6 months.
Likely outcome

All of this stuff is bad by itself but then he hit a cop. They arent going to be too easy on him. he will likely be convicted of most if not all of the charges but as far as time he will serve. the two assault charges will almost definitely run concurrent as well as the two aggravated theft charges (I'll assume theyre the 3rd degree) if they are related so that there puts him at about 1.5 years, the grand theft will also likely run on its own so theres another year to put him at 2 and throw on two months for the resisting arrest which they may just drop.

If convicted of these charges Charles will likely be sentenced to 26 months in prison and will have to serve about 14 of those months minimum.

and remember he already has 2 months time served and between now and his actual sentencing he is again recieving credit for time served.

All of this is if he goes to trial and is convicted. He could very well have worked out a plea deal by now.

The docket says that his arraignment hearing is tomorrow morning at 8:30 central (9:30 eastern, 6:30 pacific, 3:30 p.m. in Norway Tom lol)

This whole note could be moot then, but yeah. That should about sum everything up.

Charles was arraigned on both sets of charges this morning and bail was posted for the second set of charges.

It does not say he was released yet but bail has been posted on all charges and he has finally been set up for trial.

******Update******* 5/12 5:51 pm eastern

So this morning at charles' arraignment here is what happened.

He was assigned a public defender.

Charles plead NOT GUILTY to the theft charges.
Charles also plead NOT GUILTY to the assault charges

He was also told to have no contact with either victim of the assaults.

His first pre-trial hearings are set for May 18th at 9 am Central

******Update******** 5/24, 12:15 pm eastern

On May 19th Charles was reffred to a Psych Clinic, I'll assume it was to make sure he was still fit for trial since he had been in the facility for a while. They held the pre-trial hearing and the judge granted a "continuance" which basically means postponed the trial for one reason or another.

Charles is due back in court on June 2nd.

First of all, can you introduce yourself?

What's up, yall? This is Halo (aka DjH2) – A friend and musical com-padre to Mr. Charles Hamilton.

When did you start producing?

Hah! I'd say around 15-16 i first started messing with beat programs and cutting up samples, but I didn't really start taking it seriously until I was 19. I used to make a lot of Electronica (also what I DJed) before I started branching off into Hip-Hop.

How did you and Charles meet?

Charles and I met at a BBQ thrown by my homie Sciryl in like '06 – same year (lol and same place) I met my girl. He was immediately cool with me and was craaaazy excited and happy to showcase his stuff for me – (lots of instrumentals and most of The Pink Lavalamp) all of which he played was dope, BTW.

How is it to work with Charles Hamilton?

Interesting to say the least. We both kind of throw that whole "i'm a producer" thing out of the window and experiment with sounds based on how we feel. He'll run through some beats of mine if he's in the mood to flow on something, or we'll build on it together. It's crazy to keep up with him when he's in the zone, tho. His ideas come at a mile a minute.

Can you tell us about the recording process of Dope2Go and StarChaser Radio?

Dope2Go was during a more stable time in CH's life…he had a comfortable living environment, great equipment, and a DOPE lifestyle he had begun to invite me into – during one of our "highly enlightened" conversations, he approached me about doing a project on some "JayLib" type of ish – and I agreed, however I was shy on the mic back then so I took a back seat and just let him rock out on the beats. We threw that project together rather quickly, but it took me some time to come up with the right cover for it as well as send some extra beats, so in turn – the latter lalf of it got filled with the Audible Doctor and CH stuff.

Starchaser Radio was different. We did SR on some "f*ck it – let's make a dope ass EP in a DAY!" type-of-sh*t, and I had gained some confidence behind the mic and wanted to be alongside him in this project rather than taking a backseat. We had got to chill for a while that day and build on the idea of The Wig and The Mask (we both wore our apparatuses during the majority of the recording process) and everything came natural. It had originally started with me wanting him to lay down some vocals on the "Superpowers" (http://soundcloud.com/halonyc/superpowers) beat I created, but that wasn't working out for us – and we just jumped on some other beats – he would brew up an idea for the track and go in the booth and start freestylin' wildness off of the top. While he was doing this, I'd be writing my verse – trying to catch up to him!
I spent mad time playing Marvel vs. Capcom 2 on Dreamcast tho while he lined shit up and made sure it sounded like how he wanted it to. People complain about the quality of SR and they don't get that he made it sound that way on purpose, like it was a broadcast – not just a mixtape.

How would you describe Charles?

Misunderstood. The only person that could ever understand Charles, is CHARLES. Every thing from his thought patterns down to the way he dresses, is unique. People try and analyze Charles, but he's such a sporadic and "out-of-this-world" type of dude that you can't even label him as anything. Even me, I'd like to say I know Charles – but I don't really. I think that he's a talented artist who had it all and lost it all, but then again who am I to say that? Maybe he found himself in a lot of ways by losing all of the material things…who knows. Charles Hamilton dances on the tightrope between Revolutionary and Psychopath better than anyone else can.

Do you have any upcoming projects in the future?

Man, I'm about to have a baby girl in the next 6 weeks or so – so right now that's the main "PROJECT" I'm focused on! Music will ALWAYS be there and I'm sure when my daughter gets here, she'll influence even more magical beats and treats from me…but as of now, nothing is DEFINITE. I would love to say AerosolHeart will drop this year, but I'm not 100% on that…I think the project that will drop this year will be the Lovechild Zelda project I've been working on. 2011 is the year of the Lovechild.

How can the fans get in touch with you?

Don't hit me up on Facebook Chat! You'll be disappointed! Nah, I just barely am on that shit and sometimes fans take it personal when I don't respond…if you leave me a wall post or send me a MSG, i'll usually get back to you…but if you're a garbage rapper just looking for tracks, I probably won't respond. Nothing personal, I'm just picky with who has dibs to my sh*t…

Any last words?

Last words, eh? The more of the truth you know, the more fearful this world becomes. It's not what you know, It's WHO you know. I am a person of sound mind and body just like you, so it is with equality that I treat my fellow man. I feel in these times, it has become so easy and almost fully accepted to scorn others. Those that live in houses of glass should not throw stones. Yes, Charles was WRONG for what he did. But do we know WHY he did it? Yes he "broke the law", but who's law is it that we live under? Read the contracts you sign. NewCo is no better than Interscope. The Charles I know wouldn't have spazzed like this without provocation or (perhaps) means of escape…meaning to say that maybe this act was done as a way to "get out" of something…who knows. I theorize a lot. We all have a role to play in this society and a debt to pay to this country for being it's inhabitants. Make sure you pay off that debt wisely. NOTHING in this world is free.
